REGULATIONS FOR THE USE OF THE PROGRAMME
"TARNOWSKIE GÓRY KARTA MIESZKAŃCA" PROGRAMME

§ 1
GENERAL PROVISIONS

1. These Regulations set out the rules for the issuance of the Card and use of the "Tarnowskie Góry Resident Card" Program.
2. Users are obliged to familiarise themselves with these Regulations and accept their content at the latest at the moment of providing identification data necessary to receive the Card by the User, which is a prerequisite for the conclusion of the Agreement for the use of the Card and the receipt of the Card, as well as to comply with its provisions during the validity of the Agreement.
3. The content of these Regulations is available on the Website of the Programme and at the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at 4 Rynek Street.
4. The organiser of the "Tarnowskie Góry Resident Card" Programme is the Commune of Tarnowskie Góry.
5. The parties to the agreement on the use of the "Tarnowskie Góry Resident Card" Program are the Commune of Tarnowskie Góry and the User.

§ 2
DEFINITIONS

The terms used in the Regulations shall mean:

1. Program - should be understood as the "Tarnowskie Góry Resident Card" Program;
2. Card - Tarnowskie Góry Resident Card, in plastic or mobile form, personalised, entitling its User to discounts, reductions, preferences and entitlements offered by Merchants and Partners, according to the current list published on the Programme Website, also fulfilling the function of a library card;
3. Merchant/Organiser - the Municipality of Tarnowskie Góry;
4. User - a natural person who has concluded the Card Use Agreement;
5. Card Agreement or Contract - the Regulations accepted by the User;
6. Regulations - Regulations of the "Tarnowskie Góry Resident Card" Program;
7. Web Application - an application launched in the User's web browser, through which the User may create an account and manage it;
8. Mobile application - an application for mobile devices downloadable from the Google Play and App Store, installed in the User's mobile phone (smartphone) or other compatible electronic device and enabling the creation and management of the User's account;
9. Tarnowskie Góry Commune - the organiser of the Program with its seat in the Municipal Office in Tarnowskie Góry, 4 Rynek Street, 42-600 Tarnowskie Góry;
10. Partner - entity granting on its own initiative discounts, reductions, preferences and entitlements to the Card Users;
11. Customer Service Point - the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4; Contact details are provided on the Programme website;
12. Programme Site - the website of the "Tarnowskie Góry Resident Card" Programme;
13. Password - a four-digit password defined by the User and used to log into the User's account;
14. Login - User's identifier in the form of a string of characters defined by the User or the User's Card number (used interchangeably), serving for logging into the User's account;
15. Contractor - BPROG Spółka z ograniczoną odpowiedzialnością with registered office in Ząbki (05-091), ul. Wojska Polskiego, nr. 18, lok. 1, entered in the Register of Entrepreneurs of the National Court Register under KRS number: 0000554257.

§ 3
USERS AND PRINCIPLES OF ISSUING THE CARD

1. The card may be issued as:
   1. Mobile Card (Mobile Application),
   2. Plastic Card, which is attached as Appendix No. 1 to these Terms and Conditions.
2. The User may receive only one number of the Card and may use all forms of the Card referred to in paragraph 1 simultaneously and interchangeably.
3. The Card is issued:
   1. through the Web Application (mobile Card only), which can be operated from a desktop computer, a laptop computer or a mobile device;
   2. in the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4 (plastic card, mobile card), after the introduction of the User's data and confirmation of his/her eligibility for the Card (Card activation).
4. A specimen application for joining the Programme and issuing the Card in the form of a plastic or mobile card is in appendix no. 2 to these Rules.
5. The application for issuance of the Card may be submitted via the online application, mobile application or in person at the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4.
6. The application for a Card may be submitted:
   1. in the case of a natural person who has full legal capacity - in person; the person may also submit the application on behalf of own or adopted minor children, adopted under foster care (up to 26 years of age) or by proxy (in the case of a proxy, only at the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4 Street);
   2. in the case of persons not having full legal capacity to act - by a parent or legal guardian;
7. It is possible to activate several User Cards in the Mobile Application on one mobile device or via one account in the Web Application (e.g. Cards of several members of the User's family.
8. The use of the Mobile Application requires its installation in the User's mobile phone (smartphone) or other compatible electronic device. In order to use the Mobile Application correctly, the User's electronic device on which the Mobile Application is installed must have the parameters indicated in Google Play or the App Store.
9. In order to use the Web Application correctly, the User's IT infrastructure on which the Web Application is run must function correctly in the following browsers in versions at least Google Chrome 75, Mozilla Firefox 68, Safari 12, Microsoft Edge 40, Internet Explorer 11, Opera 62 and newer.
10. The plastic card is issued at the request of the User only in the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4, as a personalised card with the User's name, surname and photograph printed on it.
11. Persons are eligible to join the Programme:
    

    GROUP	PERSONS	SUPPORTING DOCUMENTS
    1	accounting for their personal income tax in Tarnowskie Góry and declaring the Municipality of Tarnowskie Góry as their place of residence in their tax return	- first page of the income tax return for the previous year
    2	who settle agricultural tax due to their agricultural holding in Tarnowskie Góry and declare in the agricultural tax return as their place of residence the Commune of Tarnowskie Góry	- a valid agricultural tax assessment decision or - the first page of the information on agricultural tax - form IR
    3	registered for permanent or temporary residence in the area of the Commune of Tarnowskie Góry, who are under 26 years of age and are exempt from the obligation to pay personal income tax with the so-called "relief for young people"	- PIT˚11 tax information for the previous year or - in the case of submission of PIT-11 information via the Internet - UPP (official certification of submission)
    4	children of persons in groups 1 to 3 up to the age of 18
    5	persons with no income raising children under 18 years of age, registered for permanent or temporary residence in the municipality of Tarnowskie Góry	decision granting benefit 800+
    6	persons studying, between 18 and 26 years of age, registered for permanent or temporary residence in the area of the Municipality of Tarnowskie Góry	- current school or student ID card, - declaration of the pupil/student constituting Attachment No. 3 to the Regulations
    7	pensioners registered for permanent or temporary residence in the area of Tarnowskie Góry Commune	pensioner ID card

    
    
12. If the Card Agreement is concluded by proxy, the power of attorney should include, at least, the power to apply for the Card and to conclude the Card Agreement. The power of attorney should be granted at least in ordinary written form. The conclusion of the Agreement for the use of the Card by proxy is possible only at the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4.
13. Before concluding the Agreement for the use of the Card, the User provides the following data in the application form:
    1. name and surname;
    2. a recent 35x45mm photograph; on its reverse side a description - first and last name - should be included. If the application is submitted in the application, the photograph must be attached in JPG or PNG format with a min. 300 pixel resolution. The photograph should be taken against a solid light-coloured background and include the whole head. The person in the photograph should be without tinted glasses and headgear, with the exception of persons wearing headgear for religious reasons. The photograph attached to the paper application is returnable upon receipt of the Card. A photograph is not required for persons under 18 years of age applying for a plastic Card;
    3. PESEL or, failing that, date of birth;
    4. residential address;
    5. telephone number and/or e-mail address of the User, together with an indication of the default communication channel;
    6. a document confirming the power of attorney to submit the application on behalf of another person - this applies, among others, to proxies;
    7. in the case of membership in the "Family 5+" programme carried out by the Tarnowskie Góry Municipal Office:
       - number and expiry date of the card
       Discounts from the Programmes do not add up.
14. When submitting the application, it is necessary to present or attach to the online or mobile application the documents confirming the entitlement to the issuance of the Card listed in the table (paragraph 11).
15. If it is not possible to provide a telephone number or e-mail address, an employee of the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4 will provide a special login to obtain the Card.
16. If there is a need to supplement the missing data or documents, the person accepting the application will inform the User about this fact when submitting the application in the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4 or up to three working days from the date of submitting the application in the Web Application or Mobile Application.
17. The User's Account is protected by the User's Login and Password, which the User establishes on his/her own in the process of applying for the Card.
18. The conclusion of the Card Agreement by the User with the Municipality of Tarnowskie Góry takes place respectively at the moment:
    1. activation of the Mobile Card in the mobile application or in the online application,
    2. issue of an active plastic Card to the User.

§ 4
RULES FOR USING THE CARD

1. The Card is issued as a personalised Card, which means that it is assigned to its User and may only be used by that User.
2. In order to receive a discount, concession, preference or entitlement, the Card must be presented to the Merchant or a Partner when paying a fee/ticket, entering an institution for an event or during ticket control. A person not carrying the Card will not be entitled to a discount.Partner does not have a list of Card Users.
3. Discounts, concessions, preferences and entitlements under the Programme are available to children under 6 years of age on the basis of a valid Card of the parent or legal guardian.
4. The Card is issued free of charge.
5. The Card confirms the User's entitlement to certain discounts, concessions, preferences or entitlements at Merchants, whereby the amount of discounts may vary for different groups of Users. Discounts may be subject to a quantity limitation at a given time or for a given type of service. Information in this regard will be posted on the Programme Site. Verification of entitlement and identity is done by scanning the QR code from the Card using: the verifier application, the reader or confirmation by the Merchant upon presentation of the Card.
6. Verification of entitlement by the Merchant to use the Card's discounts aimed at users of other programmes: "Family 5+" takes place on the basis of presentation of the current Card.Discounts from the Programmes do not add up.
7. Verification of entitlements for persons under 18 years of age with the use of a plastic Card on which there is no photograph of the User requires the User to have another document with a photograph allowing identification.
8. Verification of entitlement by the Programme Partner to use the discounts of the Card is based on the presentation of a valid Card.
9. The Card does not have the function of a payment instrument (e-purse).
10. The User may manage the Card through the User account created in the Web Application or Mobile Application. The Web Application and Mobile Application enable the Card Users:
    1. access to information on current price lists and discounts and on temporary promotions and discount actions;
    2. display of discounts granted to the Card User;
    3. display of the validity period of entitlements under the Card;
    4. change of the Password and Login;
    5. checking the accuracy of the Card User's personal data;
    6. activation of the Mobile Card, deactivation of the Card takes place only via the Web Application or in the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4;
    7. blocking of the Card and applying for reissuance of the Card takes place only through the Online Application or in the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4;
    8. downloading the history of transactions performed with the Card is done only via the online application;
    9. communication with the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4 in matters related to the Card (sending and receiving messages);
    10. requesting deletion of an account/anonymisation of data;
    11. performing the activities described in points 1-9 above in relation to the Card for family members.
11. The Card, both in the form of a mobile Card and a plastic Card, is issued in perpetuity, subject to a limitation of the entitlement to hold discounts, which are valid for a period of 24 months. The validity of the discounts shall be extended upon fulfilment of the requirements set out in §3 section 14 of the Terms and Conditions.

§ 5
OBLIGATIONS OF THE USER AND THE MUNICIPALITY OF TARNÓW MOUNTAINS AND RESPONSIBILITIES

1. The User is obliged to use the Card in accordance with the rules arising from the provisions of these Regulations, generally applicable law, as well as rules of social coexistence. 2.
2. 2. The User is obliged to use the Card safely and not to make it available to unauthorized persons. 3.
3. 3. the User is obliged to protect his/her authentication data, in particular the Login and the Password, in such a way as to prevent access by unauthorised persons.
4. (4) In the event of a disclosure or suspicion of disclosure to unauthorised persons of data referred to in section 3, loss or damage to the Plastic Card, the device on which the Mobile Card is installed or on which the Web-based Application is run, only the User is authorised to take action to change the data or to order the blocking of the Card.
5. In order to request blocking of the Card, the User or the User's proxy/parent/legal guardian, in addition to the actions described in paragraph 4, may take the aforementioned actions in person at the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4.
6. The Commune of Tarnowskie Góry is not liable for any damage caused by the use of the Card, including those caused by the occurrence of the event specified in paragraph 4, until the Card is blocked. The Card User is liable for any damage occurring during that period. 7.
7. In the event of destruction, damage, loss of the plastic card, or change of data on the plastic card, the User or his/her representative applies for a duplicate. The issuance of a duplicate Plastic Card is subject to a fee at the rate announced on the Programme Website. In order to receive a Plastic Card again, the User fills in an application for issuance of the Card (Appendix No. 2 to these Rules), ticking the box "issue of a duplicate". 8.
8. (8) In order to obtain a duplicate of the Card, the User or his/her proxy/parent/legal guardian reports in person to the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4.
9. 9. the Commune of Tarnowskie Góry is not liable for culpable actions of the User that constitute a breach of the Regulations or of generally applicable law.

§ 6
TERMINATION OF THE AGREEMENT ON THE USE OF THE CARD

1. The agreement on the use of the Card is concluded for an indefinite period of time.
2. Deletion of the Card User's account is tantamount to blocking the Card and termination of the Card Agreement.
3. Submission by the User of an application to withdraw from the Programme is tantamount to the submission of a notice of termination of the Agreement for the use of the Card and results in blocking of the Card, removal of the User's account and termination of the Agreement with effect from the date of submission of the application to withdraw from the Programme, specimen of which is attached as Appendix 4 to these Terms and Conditions. Submission of a request by the User may take place:
   1. through the Mobile Application or the Web Application - by deleting the User's account in the Application;
   2. in writing by sending the application to the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4
   3. in person at the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4.
4. The Commune of Tarnowskie Góry has the right to terminate the agreement at any time with immediate effect in the case of a culpable gross violation of the Regulations by the User. The Commune of Tarnowskie Góry is entitled to this right from the moment of obtaining information about the gross violation of the provisions of the Regulations by the User. In the case of such circumstances the User is obliged to immediately return the Plastic Card.
5. The Municipality of Tarnowskie Góry has the right to terminate the agreement in the case of the User's loss of rights to its possession as specified in § 3.14 with the lapse of a month's notice period. The right to terminate the agreement arises from the date of becoming aware of the reason for termination.

§ 7
AMENDMENT TO THE TERMS AND CONDITIONS

1. The User has the possibility to get acquainted with the current content of the Rules and Regulations, which is made available on the Programme Website and in the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at 4 Rynek Street.
2. The User is informed of each change to the Rules and Regulations on the Programme Website and in the Department of Culture, Tourism and City Promotion of the Municipal Office in Tarnowskie Góry at Rynek 4, not later than on the day before the change to the Rules and Regulations comes into force.
3. If the User has not lodged a written objection to the amendments to the Rules and Regulations prior to their effective date, it is deemed that the User has agreed to their introduction. Filing an objection is possible only in the form specified in § 6.3 and is tantamount to termination of the Card Agreement as of the day preceding the effective date of the proposed changes.

§ 8
PROTECTION OF PERSONAL DATA

1. The processing of the User's personal data is carried out in accordance with the principles set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation - RODO).
2. Detailed information on the processing of the Users' personal data can be found in the information clause constituting Appendix No. 5 to the Terms and Conditions.
3. The administrator of the personal data of the Card Users is the Mayor of the City of Tarnowskie Góry
